The FDA says it is aware that flavored e-liquids are popular with young adults, but that adults also need to be protected contrary to the over-selling of the products by adult consumers. Based on the FDA’s warning letters, a number of the e-liquids involved had no flavor; however, these were being offered accessible in candy bars disguised as a healthy snack.
Cool Cloud Vapor had marketed its e-liquid product as a supplement and a sports drink. These claims were misleading, the FDA states, because no FDA regulatory criteria or laws exist to modify dietary supplements and sports drinks. The business’s application for a non-prescription industry distribution label especially stated that the product could be used as a dietary supplement.
